ORDER 21.04.2025 Petitioners are aggrieved of Notice No. 324/NTY dated 20.03.2024, issued by the Executive Magistrate First Class, Yaripora, Kulgam-the respondent, vide which they have been called upon to show cause as to why they be not ordered to execute a bond amounting to Rs. 5000/- each with two sureties for maintaining peace for the period of six months. Mr. Alla ud Din Ganai, learned counsel for the respondents has fairly admitted that the impugned Notice has not been issued as per the procedure envisaged under law. In view of the above, the present petition is allowed and the impugned Notice is set aside. However, respondents shall be at liberty to issue fresh Notice against the petitioners strictly in accordance with law.
Disposed of along with connected CrlM.
