The petitioner has been made accused in connection with Pithoria P.S. Case No. 109 of 2023 corresponding to G.R. No. 903 of 2024 for the offences registered under Sections 419, 420, 467, 468, 471, 474, 427, 452, 506 and 120B of the Indian Penal Code, pending in the court of Smt. Archna Mishra, learned JMFC, Ranchi. Co-accused Samir Kumar Bose executed a fake power of attorney in favour of one Nirmal Kumar Sharma showing himself to be the owner of the land, which actually belonged to the brother of the informant namely Prashant Kumar Ghose. On the basis of this fake power of attorney, Nirmal Kumar Sharma sold the said land to several co-accused persons. Petitioner is alleged to have identified the power of attorney holder in the sale deed. It was submitted that co-accused Samir Kumar Bose and Prabir Dey have been granted bail by this court earlier. It was further submitted that brother of the informant namely Prashant Kumar Ghose is still in possession of the land. It was further submitted that purchasers have given an undertaking that they will not claim their purchased land. In view of the submission made above, I am inclined to release the petitioner on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of Smt. Archna Mishra, learned JMFC, Ranchi in connection with Pithoria P.S. Case No.109 of 2023 corresponding to G.R. No. 903 of 2024. (Ambuj Nath, J.) Jay/-
