Heard Mr. B M Deka, learned counsel for the petitioner and Mr. D P Goswami, learned Additional Public Prosecutor, Assam. By this application, filed under Section 483 of the BNSS, 2023, the petitioner, namely, Ruhi Sonar, has prayed for release on bail who was arrested in connection with Hatigaon P.S. Case No. 16/2025.
Page No.# 2/2 The petitioner herein worked as a Receiptionist in a gym, which is owned by the informant. The informant has alleged in the FIR that the petitioner used to collect fees from the members of the gym and since January, 2024 she did not credit the money into his bank account. It is alleged that she used to deposit the money into her bank account. The petitioner submits that she had deposited the money into her own account only after being instructed by the informant. According to the petitioner, the inforamnt, in order to save himself from paying income tax, had asked the petitioner to deposit the money into her own account. I have considered the submission made by the learned counsel for both the sides. The petitioenr is a 21 (twenty one) years old girl and she has already undergone 27 days in judicial custody. This court is of the opinion that the petitioner does not deserve to be detained in custody for further period of time. Hence, the prayer for release on bail is allowed. Accordingly, the petitioner, Ruhi Sonar, who was arrested in connection with Hatigaon P.S. Case No. 16/2025 shall be released on bail of Rs.25,000/- with one surety of like amount to the satisfaction of the learned Chief Judicial Magistarte, Kamrup (M), Guwahati.
