JUSTICE MOHAMMAD NAWAZ ORAL ORDER The petitioner is seeking to quash the FIR in Crime No.371/2024 registered at Byatarayanapura Police Station, Bengaluru City, for the offence punishable under Sections 504, 420, 465, 468 and 471 of IPC. 2. The crux of the allegations in the complaint are that the petitioner who is none other than the husband of the complainant took a loan of Rs.2,00,00,000/- (Rupees Two Crores) from HFCL Bank in the year 2018 in respect of one Sproutanmins Super Food Private Limited (SSFPL) run by the petitioner as well as the complainant. While taking loan, without the knowledge of the complainant pledged the documents pertaining to the property belonging to complainant’s mother in the Bank as well as forged the signatures of the complainant and her parents and also - 3 - HC-KAR NC: 2025:KHC:52193 CRL.P No. 4366 of 2025 gave fake e-mail ID and availed additional loan of Rs.37,50,000/- (Rupees thirty seven lakhs fifty thousand only) and thereby cheated the complainant. 3. Since the allegations of cheating, forgery, etc., are made and also considering that the documents are now sent for FSL for examination, this Court is not inclined to entertain the petition seeking quashing of FIR. 4. If on completion of investigation, any adverse report is filed, it is always open for the petitioner to challenge the same, if so advised. 5. With that liberty, the petition is dismissed.
