The present writ petition has been filed for following reliefs:- “(i). For issuance of an appropriate writ(s)/ order(s)/direction(s) particularly writ in the nature in the nature of mandamus commanding upon the respondents particularly respondent no. 4 to take appropriate steps/action against the respondents 6 and 7 who are trying to dispossess the petitioner and are disturbing the petitioner over his land without having any right, authority and capacity in the land appertaining to Khata no- 83, Thana no- 43, Plot no- 627, area- 1 acres 3 Decimals, and plot no 627, area- 1 acre 08 decimals (total 2 acres 11 decimals) out of 13 acres 6 decimal (after survey), Anchal- SuriyaMauza- Nawadih, District – Giridih. (ii). Further, a prayer is being made before this Hon'ble Court for a direction upon the respondent no. 4 to immediately and forthwith consider the representation of the petitioner and take appropriate decision, and take the appropriate actions as required.” 2. Thereafter, an interlocutory application being I.A. No.7667 of 2025 has been filed to bring on record the fact that the proceeding under Section 145 Cr.P.C. is pending between the parties over the disputed piece of land. 3. The description of land is as follows:- (2025:JHHC:20879) “Land appertaining to Khata No.83, Thana No.43, Plot No.627, area-1 acres 3 Decimals, and plot NO.627, Area-1 acres 08 decimals (total 2 acres 11 decimals) out of 13 acres 6 decimal (after survey), Anchal- Suriya Mauza-Nawadih, District-Giridih.” 4. The nature of relief suggest that this issue cannot be resolved by the writ Court. 5. Accordingly, without issuing notice to the private respondents, the present writ petition stands disposed of with a direction to Respondent No. 3-the Sub-Divisional Magistrate, Giridih (before whom 145 Cr.P.C. proceeding being Case No. 10 of 2024 is pending), to dispose of the said proceeding expeditiously, after affording due opportunity to the contesting parties. 6.
