ORAL ORDER
The petitioner is before this Court seeking the following prayer:
“(a) That this Hon’ble Court be pleased to issue a Writ of certiorari or any other Writ/s, order/s, direction/s and quash the impugned orders passed on IA-4 filed under section 151 CPC for clubbing O.S.No.3256/2020 with O.S.No.1334/2023 in O.S.No.1334/2023 on the file of XV ADDL. CITY CIVIL AND SESSIONS JUDGE (CCH-3), Bengaluru dated 5.6.2025 vide Annexure – A and to allow the I.A.No.4 – clubbing both suits to be tried together. (b) To pass such other order / s as this Hon’ble Court may deem fit to grant, in the facts and circumstances of the case together with the cost of the proceedings, in the interest of justice and equity.”

2. Heard Smt.Manjula R.,
learned counsel for Sri J.M.Rajanna Setty, learned counsel for the petitioner and Sri Manjunatha B.V., learned counsel for the respondent.

Learned counsel for the petitioner submits that it would lead to conflicting orders if both the suits are tried differently to which, learned counsel for the respondent submits that both the suits are to be contested independently as the petitioner, who is the plaintiff in suit – O.S.No.1334/2023 has no documents to demonstrate that the property belongs to him. Be those submissions as they are.
4. These are disputed questions of fact, which require a contest, the contest would not mean that the suits should be clubbed and heard together.
5. Learned counsel for the petitioner now submits that the suits are being tried by one solitary Court but they are listed at different dates and would submit that if they be listed on the same day, it would suffice for the present.

6. Learned counsel for the respondent has no objection to the submission of the learned counsel for the petitioner to list the suits on the same day.
7. Therefore, I deem it appropriate to dispose the petition without disturbing the impugned order, with a direction to the concerned Court to take both the suits together on the same day, whenever they are to be taken up and regulate its procedure thereafter.
8. With the aforesaid direction, the writ petition stands
disposed. Ordered accordingly.
