Gaunjhu, APP --- 03/07.04.2025 Heard Mr. Jitendra Nath Upadhyay, the learned counsel for the petitioner and Mr. Naveen Kr. Gaunjhu, the learned APP appearing on behalf of the State. The prayer for anticipatory bail of the petitioner was earlier rejected in ABA No. 6646 of 2020 on 18.01.2021. It has been submitted by the learned counsel for the petitioner that subsequently the suit preferred by the petitioner for restitution of conjugal rights with his wife has been allowed vide order dated 28.06.2022. It has also been submitted that very recently the informant has preferred a suit for dissolution of marriage being Original Matrimonial Suit No.323 of 2024. Mr. Naveen Kr. Gaunjhu, the learned APP has opposed the prayer for anticipatory bail of the petitioner. Regard being had to the changed circumstance to the effect that the suit for restitution of conjugal rights being Original Suit No. 526 of 2019 has been allowed in favour of the petitioner and the wife has very recently instituted a suit for dissolution of her marriage with the petitioner, I am inclined to grant the privilege of anticipatory bail to the petitioner. Accordingly, the petitioner is directed to surrender before the learned trial court within four weeks from today and on such surrender, he shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of -2- learned Judicial Magistrate, 1st Class, Jamshedpur in connection with Sidhgora PS Case No. 27 of 2020 (GR No. 1973 of 2021), subject to the conditions as laid down under Section 482(2) of the Bhartiya Nagrik Suraksha Sanhita, 2023.
