Issue the writ, order or direction in the nature of certiorari and set-a- side the proceeding of Case No. 6421 of 2023 (Vidhya Devi and Others Vs. Mohan Lal and Others) pending before the court of Sub-Divisional Officer, Mughalsarai, Chandauli as it is without jurisdiction, it may kindly be pleased to be declared void ab initio, since a consolidation proceeding is pending regarding the same case and it bars the present proceeding under section 5(2)(a) of the U.P. Consolidation of Holdings Act. II. Issue the writ, order or direction in the nature of mandamus commanding and directing the respondent no. 2 to be restrained from further proceeding in Case No. 6421 of 2023 (Vidhya Devi and Others Vs. Mohan Lal and Others)." 2. From perusal of the prayers made in the writ petition, no case for interference is made out while exercising extraordinary jurisdiction under Article 226 of the Constitution of India. 3. Writ petition fails and is hereby dismissed. However, it is open to the petitioner to approach appropriate forum, if so advised.
