The complainant has filed the present complaint alleging wilful disobedience of order dated 19.12.2024 passed by the learned Single Judge in MFA No.7683/2024(CPC) C/W MFA No.7693/2024 (CPC). - 3 - HC-KAR NC: 2025:KHC:53084-DB CCC No. 282 of 2025 2. This Court had noted that the complainant was living on the second floor of the premises bearing No.28, Katha No.458, Assessment No.95 of Srigandakavalu village. 3. The principal accused is the complainant's wife. It is noted that the accused and her parents are residing on the first floor. This Court after noting the same, directed the parties to maintain status-quo and not to cause any obstruction to the parties living in their respective floors. The Court specifically directed the accused not to interfere with regard to the complainant's possession of the second floor. It was also explicitly directed that the complainant would not enter the first floor. However, it appears that the said direction has been violated. 4. The complainant has produced photographs from the CCTV which show that the accused is striking the complainant in his room on the second floor and he falling on the floor. The complainant has accordingly made a police complaint. The accused also claims that there was an altercation between them and has produced photographs to show that she was also injured. The learned counsel appearing for the accused submits that the accused tenders an unqualified apology and she would not visit the second floor. He also submits that the complaints filed by the accused with the police station would be closed. 6. Given that the dispute is essentially between husband and wife, we accept the apology tendered by the accused by taking note of the submission that the parties shall close the complaints before the concerned police station. 7. We however caution the accused not to go to second floor. If it is found that the directions are violated again, the Court would be constrained to take a stringent view. 8.
