GP FOR FINANCE PLANNING (AP) The Court made the following order: The above writ petition is filed to declare the action of the respondents in not releasing the amount of Rs.5,19,00,000/- payable to the petitioner concerning the execution of work i.e. “Widening & Strengthening of LGB Nagar to Rachur (via) Ragimekalapalli road from KM 0/0 to 12/250 in Anantapuramu District”, as illegal and arbitrary.
2. A counter affidavit was filed on behalf of respondent No.3 wherein it was stated as follows:
“… Accordingly the contractor started the work and executed the work worth of Rs.4,38,81,218/- (excluding L.S. amounts) as on

29.05.2023. Based on the work done by the contractor, necessary bill is prepared for Rs.5,19,89,613/-. The bill is not uploaded for want of necessary Budget release order for Gross Amount Rs.5,19,89,613/- and net amount of Rs.4,38,81,218/-.”
3. Heard Sri L. Sai Manoj Reddy, learned counsel for the petitioner; Sri Ch. Praveen, learned Assistant Government Pleader for Roads and Buildings, for respondents 1, 3 and 4 and Smt. Chandrika, learned Assistant Government Pleader for Finance, for respondent No.2.

Learned counsel for the petitioner submits that despite completion of the work as per the agreement No.75/2021-22 dated 29.06.2021, the respondents have not released the amount.
5. Learned Assistant Government Pleader for Roads and Buildings submits that the bill for Rs. 4,38,81,218/- is not uploaded for want of the budget release order.

Learned counsel for the petitioner, on instructions, endorsed that the net amount payable to the petitioner is Rs.4,38,81,218/-.

Given the averments in the counter affidavit, since there is no dispute regarding the petitioner’s entitlement, this writ petition is disposed of, at the admission stage with the consent of learned counsel on either side, directing the respondents to release the amount of Rs. 4,38,81,218/- to the petitioner concerning the execution of the aforementioned work, within five months from the receipt of a copy of the order. No order as to costs. As a sequel, pending miscellaneous petitions, if any, shall stand closed.
