Neutral Citation No. - 2025:AHC:113617 Court No. - 83 Case :- APPLICATION U/S 529 BNSS No. - 1871 of 2025 Applicant :- Smt Shweta Chauhan Opposite Party :- State Of U.P. And 5 Others Counsel for Applicant :- Rewti Raman Patel,Shravan Kumar Singh Counsel for Opposite Party :- G.A. Hon'ble Nalin Kumar Srivastava,J. 1. The present application under Section 529 of BNSS has been filed with a prayer to direct the Additional Sessions Judge /FTC-1, Gautam Budh Nagar to decide the Case No. 497 of 2024, arising out of case crime no. 504 of 2018, under Sections 498-A, 364, 323 IPC, Police Station Sector-39, District Gautam Budh Nagar expeditiously within a stipulated period. 2. Heard learned counsel for the applicant, learned AGA and perused the material available on record. 3. It is submitted by learned counsel for the applicant that the applicant is informant in the said case. It is also submitted that the matter is pending at the stage of evidence of informant / applicant. It is next submitted that no sincere efforts are being made by the Court concerned to decide the said case. It is further submitted that the opposite party no.2 is also applying delaying tactics in disposal of the said case. 4. A perusal of the copies of the order sheets goes to show that the aforesaid case was filed in the year 2024. It also appears that the matter is pending at the stage of evidence of informant / wife. The applicant before this Court is the aggrieved wife in the proceeding of the aforesaid case and she has to adduce her evidence before the Court concerned. Needless to say that evidence may be adduced by the applicant herself but it is very strange that instead of adducing evidence, the applicant unnecessarily knocked at the door of this Court, which is not a good practice. However, the Court concerned is directed to record the evidence of the applicant / informant within a period of two months from the date of production of certified copy of this order before it and thereafter make all endeavours for expeditious disposal of the case, if there is no legal impediment and the applicant cooperates with the trial court. It is further directed that no unnecessary adjournment will be sought/granted. 5. It is also made clear that the Court / Presiding Officer is not the only stake holder in the trial and disposal of a case, hence, besides the P.O. concerned, all the stake holders i.e. police and executive authorities, counsels, parties to the case, staff etc. are also made bound by this order and it will be their responsibility also to assist the Court in every manner for the expeditious disposal of this case. 6. With the above observations, the application stands disposed of. Order Date :- 15.7.2025 safi Digitally signed by :- MAHBOOB SAFI High Court of Judicature at Allahabad
