ORAL ORDER RULE. Learned APP waives service of notice of Rule for and on behalf of the respondent – State of Gujarat. [1.0] By way of present petition, the petitioner prays for direction directing the Respondent authorities to lodge the FIR pursuant to the written complaint dated 28.05.2024 and other subsequent complaints made by the petitioner. [2.0] Earlier the petitioner had preferred Special Criminal Application No.12962/2024 and sought direction to lodge the FIR and this Court vide
order dated 07.10.2024 directed the authority to look into the complaint of the petitioner. However, the police authorities are not properly investigated the offence, is the main grievance of the petitioner. Therefore, the petitioner is constrained to approach this Court again. [3.0] Pursuant to the report submitted by the authority and Yadi dated 01.12.2024, wherein police has opined that no cognizable offence is made out or disclosed.
R/SCR.A/16942/2024 ORDER DATED: 21/08/2025 [4.0] In view of the above, if the petitioner has any grievance qua police Yadi/report or dissatisfied with inaction on part of the respondent authorities, it is open for the petitioner to avail statutory remedy before appropriate forum under the provisions of the CrPC / BNSS and as per the law laid down in the cases of M. Subramaniam vs. S. Janki reported in (2020)16 SCC 728
as well as the decision in the case of
Imran Pratap Gadhi
vs. State of Gujarat
reported in
2025 SCC OnLine (SC) 678
rather to approach this Court under Articles 226/227 of the Constitution of India. [5.0] With the above observation, present application stands disposed of. However, the petitioner is at liberty to file appropriate proceedings before appropriate forum. It is hereby made clear that this Court has not examined the merits of the case. Direct service is permitted. Allied Misc. Application stands also disposed of accordingly.
