CASE HAVING COME UP FOR ADMISSION ON 07.04.2025, THE COURT ON THE SAME DAY PASSED THE FOLLOWING: CRL.MC NO. 3245 OF 2025 3 2025:KER:29759 O R D E R Dated this the 7th day of April, 2025 Petitioner is the 3rd accused in Crime No.710 of 2022 registered at the Angamaly Police Station for offences under Sections 8(c), 22(c), 27A and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985. The petitioner was arrested on 08.07.2022 and was granted bail as per Annexure 1 order dated 17.03.2025, with a condition that one of the sureties must be the petitioner’s near relative. This Crl.M.C is filed seeking deletion of that condition. 2. Learned Counsel for the petitioner submits that the petitioner’s family is enimical towards him for having contracted an inter caste marriage. Hence, none of the petitioner’s near relatives are willing to stand surety for him. As a result, the petitioner is languishing in jail, despite grant of bail. 3. Learned Public Prosecutor submitted that, since the offences are very serious, imposition of CRL.MC NO. 3245 OF 2025 4 2025:KER:29759 stringent conditions is justified. It is the further submission of the Public Prosecutor that after his release from jail, petitioner may threaten or intimidate his relatives for not standing surety for him. 4. In view of the submission that none of the petitioner’s near relatives are willing to stand surety for him and considering that the petitioner is continuing in jail, condition No.1) in Annexure 1 order is deleted and the following condition is incorporated; “The petitioner shall not threaten or intimidate any of his near relatives for not standing surety for his release on bail.” The Crl.M.C is disposed of accordingly.
