The instant civil miscellaneous petition under Article 226 of the Constitution of India has been filed for restoration of C.M.P No. 663 of 2019, which stood dismissed for non-prosecution on 24.01.2024. 2. Vide order dated 05.03.2025 notice was issued to the opposite party upon which the opposite party has appeared through his learned counsel. 3. Learned counsel for the opposite party has raised no objection rather he has fairly submitted that the C.M.P No.663 of 2019 may be restored to its original file so that the matter may be heard and decided on merit. 4. This Court, after having heard the learned counsel for the petitioner, considering the submission advanced on his behalf and the reason assigned in the instant civil miscellaneous petition, deems it fit and proper to restore C.M.P No. 663 of 2019, which stood dismissed for non- prosecution vide order dated 24.01.2024, to its original file. 5.
