2025:HHC:3446 IN THE HIGH COURT OF HIMACHAL PRADESH, SHIMLA CWP No.2575 of 2025 Date of Decision: 25.02.2025 _____________________________________________________________________ Nazra Khan ……...Petitioner Versus State of Himachal Pradesh & Ors. …....Respondents Coram Hon’ble Mr. Justice Sandeep Sharma, Judge. Whether approved for reporting? For the Petitioner: Mr. Parkash Sharma, Advocate. For the respondents: Mr. Rajan Kahol, Mr. B.C Verma & Mr. Vishal Panwar, Additional Advocate Generals, with Mr. Ravi Chauhan, Deputy Advocate General. ___________________________________________________________________________ Sandeep Sharma, J. (Oral) By way of instant petition, very innocuous prayer has been made by the petitioner to issue direction to respondent No. 2 to decide the appeal (Annexure P-3) filed by the petitioner in a time bound manner. 2. While accepting notice on behalf of respondents, Mr. Vishal Panwar, learned Additional Advocate General, states that appeal, if not already decided, shall be decided expeditiously. Having taken note of innocuous prayer made on behalf of the petitioner, coupled with the nature of order proposed to be passed in the instant proceedings, there appears to be no justification to call for the reply from the respondents. 3. Perusal of documents adduced on record clearly reveals that appeal having been filed by the petitioner is pending adjudication for approximately two years, as a result thereof, petitioner is continuously suffering financial loss. 3. Consequently, in view of the above, this Court, without going into the merits of the case, deems it fit to dispose of the present petition, with a direction to respondent No. 2 to decide the pending appeal (Annexure P-3) filed by the petitioner expeditiously, preferably within a period of two months from today. Ordered accordingly. Needless to say, authority concerned, while doing the needful in terms of instant order, shall afford an opportunity of being heard to the petitioner and pass speaking order thereupon. Pending applications, if any, stand disposed of. February 25, 2025 (Sandeep Sharma), (sunil) Judge 2
