INDIRESH ORAL ORDER In this writ petition, the petitioner is challenging the Endorsement/Intimation Letter dated 23rd February, 2023 (Annexure-K) issued by the respondent No.2. 2. Heard Sri. C. Shankar Reddy, learned counsel appearing for the petitioner and Sri. Mahantesh Shettar, learned Additional Government Advocate appearing for respondents. 3. Sri. C. Shankar Reedy, learned counsel appearing for the petitioner contended that there is no impediment for the respondent No.2-Sub-Registrar to register the Final Decree in terms of the compromise decree which has been made in respect of the property in question. It is also argued by learned counsel appearing for the petitioner that the petitioner is confined to his prayer for registration of Final Decree in - 3 - HC-KAR NC: 2025:KHC:48941 WP NO.5427 OF 2023 respect of the schedule property mentioned in the Draft Deed produced at Annexure-C except the item No.2 in the schedule properties, which is yet to be crystalised before the competent Court. 4. Per contra, Sri. Mahantesh Shettar, learned Additional Government Advocate appearing for respondents submits that the Draft Deed has been produced by the petitioner for registration, much before passing of the Final Decree, which is not permissible under law. Accordingly, he sought to justify the impugned Endorsement/Intimation Letter dated 23rd February, 2023 (Annexure-K) issued by the respondent No.2. 5. In the light of submission made by learned counsel appearing for the parties, on careful examination of the Draft Deed produced at Annexure-C, the same would indicate that, except for the item No.2 of the schedule properties mentioned therein, the decree has been passed by the competent Civil Court. Therefore, the petitioner shall present the fresh Deed for registration of document along with copy of the Decree being passed by the competent Civil Court in respect of the - 4 - HC-KAR NC: 2025:KHC:48941 WP NO.5427 OF 2023 schedule properties. In the event, if the petitioner presents such Draft Deed along with relevant documents to substantiate the Title in respect of the schedule properties before the respondent No.2, the respondent No.2-Sub-Registrar shall register the Final Decree that may be produced by the petitioner in accordance with law.
