1. Leave to amend prayer clause. Necessary amendment be carried out accordingly. 2. By way of the present petition under Article 226 of the Constitution of India, the petitioner has made following prayer:-
“9(B). To issue a writ directing the respondent no.2 to renew the passport of the petitioner having number Z4421727 for a period of two years;”
3. According to the petitioner, he has applied for re-issue of passport as per passport application form annexed at Annexure-B to the petition. It appears that upon police verification, it was revealed that one offence is registered at Vejalpur police station being C.R.No.II-3152 of 2014 under Section 188 of the Indian Penal Code. According to the petitioner, he has paid the fine amount and was released on same day within 30 minutes. No record as to any charge-sheet was found in the offence but, without going into the fact whether the chargesheet is filed or not, the offence alleged against the petitioner is a pretty offence and, therefore,
R/SCR.A/15862/2024 ORDER DATED: 27/06/2025 appropriate order for renewal of the passport at-least for a period of two years may be passed. 4. At this stage, it is relevant to note that the application to renew the passport is pending and further it is also relevant to refer to the Notification issued by the Ministry of External Affairs dated 25.08.1993.
The issue raised in this application is governed by the said notification which reads as under:-
“G.S.R. 570 (E)- In the power conferred by clause (a) of the Section 22 of the Passport Act, 1967 (15 of 1967) and n suppression of the notification of the government ofIndia in the Ministry of External Affairs No.G.S.R. 298 (E), dated the 14th April, 1976, the central government being of the opinion it is necessary in public interest to do so, hereby exempts citizen of India against whom proceedings in respect an offence alleged to have been committed by them are pending before a criminal court in India and who produced order from the court concerned permitting them to depart from India, from the operation of the provisions of clause (f) of sub-section (2) of Section 6 of the said Act, subject to the following conditions, namely:- (a) the passport to be issued to every such citizen shall be issued- (I) for the period specified in order of the court referred to above, if the court specifies a period for which the passport has to be issued;or (II) if no period either for the issue of the passport or for the travel abroad is specified in such order, the passport shall be issued for a period one year. (III) If such order gives permission to travel abroad for a period less than one year, but does not specify the period validity of the passport, the passport shall be issued for one year, or (IV) if such order give permission to travel abroad for a period exceeding one year, and does not specify the validity of the passport, then the passport shall be issued for the period of travel abroad specified in the order. (b) Any passport issued in terms of (a) (ii) and a (iii) above can be further renewed for one year at a time, provided the applicant has not travelled abroad for the period sanctioned by the court, and provided further that, in the meantime, the order of the court is not cancelled or modified.
R/SCR.A/15862/2024 ORDER DATED: 27/06/2025 (c) any passport issued in terms of (a)(i) above can be further renewed only on the basis of the fresh court order specifying a further period of validity of the passport or specifying a period for travel abroad. (d) the said citizen shall give an undertaking in writing to the passport issuing authority that he shall, if required by the court concerned, appear before it at any time during the continuance in force of the passport so issued.”

In view of above, respondent No.2 is directed to process the application filed by the petitioner herein annexed at Annexure – B for renewal of passport with a validity period of two years in terms of notification referred to above. Such exercise shall be completed as expeditiously as possible but, not later than two weeks from the date of receipt of this order. 6. With the above observation and direction, present petition stands
disposed of. Direct service is permitted.
