Sri Narasaiah, complainant is present. GPA holder of Smt.Mahadevamma/responde t is present and files special power of attorney executed by the respondent. 2. A joint memo is filed by both the parties which reads as under : The Appellant & respondent above submits as under:
1. In the top noted appeal, the appellant has challenged the order of acquittal dated 01/08/2017 passed by the LXII Additional City Civil & sessions Judge, Bengalure in Crl.A.No.655/2016 setting aside the order of conviction dated 04/05/2016 passed by the XXII Addl. Chief Metropolitan Magistrate, Bengaluru for the offence U/S 138 of NI Act. 2. Due to the intervention of friends & relatives, both parties have settled the matter amicably. - 3 -

3. The Respondent agreed to pay cash of Rs.80,000/- towards full and final settlement of Cheque amount of Rs.1,50,000/-. The appellant has agreed to receive Rs.80,000/- as against cheque amount of Rs.1,50,000/- towards full and final settlement. Herein after both parties have no monetary claims against each other. Respondent is represented by GPA holder and copy of Power of Attorney is Produced. 4.
Hence, both parties humbly pray that this Hon'ble Court be pleased to dispose the top noted appeal in terms of joint memo in the interest of justice and equity. 3. It is submitted that the appellant has received Rs.80,000/- from the respondent towards full and final settlement. The conditions of the joint memo is read over and explained to both the parties and both the parties agreed to the same. Hence, in view of the joint memo, the appeal is disposed of.
