Sri Satish Sharma, learned counsel for the applicant on instructions submits that though the application under Section 528 of BNSS has been preferred by the applicant for quashing the impugned N.B.W. order dated 7.8.2023 as well as Section 82 Cr.P.C. issued on 16.10.2023 by Additional Chief Judicial Magistrate, Court No. 8, Allahabad as well as entire proceeding of Complaint Case No 2623 of 2017 (Vinay Vaish Vs. Manish Prakash), under section 138 of N.L. Act, Police Station- Dhoomanganj, District-Allahabad, pending before the Court of Additional Chief Judicial Magistrate, Court No. 8, Allahabad, however, he confines the prayer for enlargement of bail before the court below. 2. Learned A.G.A. has no objection to the same. 3. Considering the submissions raised at the Bar and the statements so sought to be made by them, the application stands disposed of while observing that in case appropriate proceeding in the form of bail application is preferred before the court below, then this Court has no reason to disbelieve that the same shall be decided with most expedition strictly in accordance with the law of the land keeping in view the judgment in the case of Satender Kumar Antil Vs.
