ORDER This application has been filed by the applicant / plaintiff seeking issuance of summons to Mrs.Vijayalakshmi, D/o.M.Kannan and W/o.Rajan, residing at AP 254, 11th East Cross, 3rd Main Road, MKB Nagar, Vyasarpadi, Chennai – 600 039, to attend this Court and give evidence on behalf of the plaintiff in T.O.S.No.68 of 2016. 2. The applicant has filed the Testamentary Original Suit in respect of the registered Will dated 31.05.1993 said to have been executed by late J.Selvaraj. The death certificate of M.Kannan has been produced before this Court, which shows that he died on 02.02.2003. Therefore, the applicant seeks to examine Mrs.Vijayalakshmi for identifying the signature of her father M.Kannan, the deceased attesting witness, and for proving the relevant circumstances relating to the Will. 4. Considering the nature of the testamentary proceedings and the fact that one of the attesting witnesses is no more, this Court is of the view that the evidence of the proposed witness is relevant and necessary for adjudication of the suit. 5. Accordingly, this application is allowed.
