Chamin Ahmed who have filed this application under Section 482 of the BNSS, 2023 with a prayer for pre-arrest bail as he is apprehending arrest in connection with Krishnai P.S. Case No. 02/2025 ( GR No.54/2025) under Section 118(2)/109/3(5) of BNS, 2023.. 2. Mr. D.P.Goswami, learned Addl.Public Prosecutor is present for the respondent State. 3. It is submitted by the learned counsel for the petitioner that as per FIR, the son of the petitioner Nos. 1 and 2 had assaulted the brother of the informant causing grievous injuries on his person. There is no allegation against the petitioner Nos. 1 and 2 and they are not involved in the alleged incident. The only allegation against them is that, in spite of witnessing the incident, they did not interfere. It is also submitted that there is no reflection in the FIR regarding the involvement of another son of the petitioner Nos. 1 and 2 i.e. petitioner No. 3. 4. I have considered the submissions at the Bar. 5. I have scrutinized the Case Diary. 6. The petitioners have been granted interim bail vide order dated 06.02.2025 by a co-ordinate Bench of this Court. Page No.# 3/3 7. Case Diary reveals that the petitioners have appeared before the I.O. and their statements have been recorded. They have not violated the bail conditions.
