Neutral Citation No. - 2025:AHC:103216-DB Chief Justice's Court Case :- SPECIAL APPEAL No. - 595 of 2025 Appellant :- Lallan Yadav Respondent :- State of U.P. and 3 others Counsel for Appellant :- Anil Kumar, Ashok Kumar Upadhyay, Yasharth Upadhyay Counsel for Respondent :- C.S.C., Pradeep Singh, Rajiv Singh (SC) Hon'ble Arun Bhansali,Chief Justice Hon'ble Kshitij Shailendra,J. 1. This appeal is directed against the order dated 29.05.2025 passed in Writ-C No. 15570 of 2025, whereby the petition filed by the appellant though has been dismissed, in view of the prayer made by the appellant, a direction has been given to the respondent no. 2 to conclude the proceedings initiated against the appellant expeditiously. 2. Learned counsel for the appellant attempted to make submissions that the finding recorded by the learned Single Judge, on the plea raised by the appellant in the petition, is incorrect and only under the threat of cost, the submissions regarding issuing of directions were made and, therefore, the matter is required to be examined by this Court in appeal. 3. Having heard learned counsel for the appellant and having perused the order passed by the learned Single Judge, we are firmly of the opinion that having made submissions before the learned Single Judge seeking a particular prayer, which prayer has been granted, filing of the appeal seeking to question the order on merit qua the plea which apparently was substituted with the prayer as has been granted, cannot be countenanced. 4. In case the appellant has any grievance qua what transpired before the learned Single Judge, the only remedy for the appellant is to approach the same court by way of review. 5. In view thereof, no case for entertaining the present appeal is made out. The same is, therefore, dismissed, leaving it open for the appellant to take appropriate proceedings in accordance with law.
