HARPREET SINGH BRAR, J. (ORAL) The present criminal writ petition has been filed under Articles 226/227 of the Constitution of India for issuance of a writ in the nature of mandamus by directing respondents No.1 to 3 to protect the life and liberty of the petitioners at the hands of private respondents.
Learned counsel for the petitioners contends that petitioner No.1 is married to respondent No.4 and living separate for the last two years and out of this wedlock, one male child was born, who is presently residing with respondent No.4. Now, the petitioner No.1 is living with petitioner No.2, who is a divorcee, in live in relationship but the said relationship is not acceptable to respondents No.4 to 7 and they are threatening to petitioners with dire consequences. The petitioners apprehend danger to their life and liberty from respondents No.4 to 7 and in this regard, submitted a representation dated 26.05.2025 (Annexure P-3) to respondent No.2 but no action has been taken so far. directed to supply a copy of complete paper book to the counsel appearing for the State during the course of the day. Without commenting on the validity of their relationship and entering upon an exercise to evaluate the evidentiary value of the documents placed on the file, I dispose of this petition with direction to respondent No.2 to decide the representation of the petitioners (Annexure P-3) within a period of one week from the date of receipt of a copy of this order and and grant them protection, if there is any threat to their life and liberty in accordance with law. It is made clear that this order shall not be taken to protect the petitioners from legal action for violation of law, if any committed by them.
