Serial No. 10 REGULAR LIST IN THE HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT SRINAGAR CrlA(D) 13/2023 UNION TERRITORY OF J AND K THROUGH SHO POLICE STATION SUMBAL …Petitioner/Appellant(s) Through: Mr. Mohsin Qadri, Sr. AAG with Ms. Maha Majeed, Assisting Counsel Vs. MOHAMMAD RAFIQ HURRA ...Respondent(s) Through: Mr. Rabinder Singh, Advocate CORAM: HON’BLE MR. JUSTICE SANJEEV KUMAR, JUDGE. HON’BLE MR. JUSTICE SANJAY PARIHAR, JUDGE. ORDER 23.07.2025 This is an appeal under Section 21 of the NIA Act challenging an order dated 14-12-2022 passed by the Additional Sessions Judge, Baramulla [Special Court Designated under Section 22 of NIA Act] [“the trial court”] in case file No. 347/ASJB [FIR No. 69/2020]. On being asked, Mr. Mohsin Qadri, learned Sr. AAG submits that the trial in the case is almost complete and all the prosecution witnesses stand examined. He, however, submits that the impugned order granting bail to the respondent is not in consonance with law and deserves to be set aside. He has taken us through the impugned order and also the evidence on record. Having heard learned counsel for the parties and perused the material on record, we are of the considered opinion that this is not the stage to interfere with the impugned order granting bail to the respondent, for the reason that the trial is now at the final stage and only the arguments of the parties are to be addressed. In view of the aforesaid, this appeal is dismissed. Let the trial Court hear the matter finally and pass appropriate orders in accordance with law.
