Petitioners are arraigned as accused Nos.1 and 2 in Cr.No.146/2025 of R.T.Nagar Police Station, Bengaluru City, registered for the offence punishable under Section 118(1), 352 r/w 3(5) of BNS, 2023. 2. Heard the learned counsel for petitioners, the learned HCGP for the State and perused the material on record. 3. This petitioner is preferred under Section 483 of BNSS, 2023 to enlarge the petitioners on bail. 4. In the complaint lodged by the victim by name Rehan Ahamed, it is alleged that on 17.6.2025, when he

was near Reddy Garage, Mecca Masjid, Ganganagara, R.T.Nagar, Bengaluru, both accused Nos.1 and 2 came and picked up quarrel with him regarding money matter, abused him and accused No.1-Waseem stabbed him with a knife on his neck. His relative by name Tanveer Ahmed shifted him to Bowring Hospital and admitted as an in-patient. 5. The learned counsel for petitioners submits that the complainant and the accused are closely related. Incident took place on account of some petty issue. Initially, case was registered under Section 118(1) of BNS i.e., for causing simple injury. He submits that there is an inordinate delay in lodging the complaint, no MLC was sent from the hospital and the victim is already discharged from the hospital. 6. Learned High Court Government Pleader contended that accused No.1 was armed with a knife when he came to the spot and both the accused picked up quarrel with the complainant and accused No.1 stabbed on

his neck. He contended that in the course of investigation, further statement of the complainant was recorded and Section 109 and 351(3) of BNS have been invoked. He contended that in view of the nature of allegations and gravity of the offence, petitioners are not entitled for bail. 7. The incident is alleged to have taken place during midnight on
17.6.2025. It is stated that immediately, a relative of the victim shifted him to Bowring Hospital for treatment. However, complaint is lodged by the victim on 19.6.2025. 8. I have perused the wound certificate of the complainant, as per which he has sustained cut wound in the anterior aspect of the neck. The said injury is mentioned as simple in nature. 9. Petitioners have no criminal antecedents.

Hence, by imposing conditions, petitioners can be enlarged on bail. Hence, the following:
ORDER I. Petition is allowed. II. Petitioners/accused Nos.1 and 2 in Crime No.146/2025 of R.T.Nagar Police Station, Bengaluru City, shall be enlarged on bail, subject to following conditions:
1. They shall execute a personal bond for a sum of Rs.50,000/- (Rupees fifty thousand only) each, with two sureties for the likesum to the satisfaction of the jurisdictional Court.
2. They shall furnish proof of their residential address and shall inform the Court, if there is change in the address.
3. They shall not directly or indirectly tamper with the prosecution witnesses.
4. They shall not indulge themselves in committing any offence.

5. They shall appear before the trial Court regularly on all dates of hearing.
6. They shall mark their attendance before the R.T.Nagar Police Station on every Sunday between 10.00 am to 1.00 pm till conclusion of investigation.
Violation of condition/s shall result in cancellation of bail.
