Neutral Citation No. - 2025:AHC:89076 Reserved On:-20.05.2025 Delivered On:-26.05.2025 Case :- CRIMINAL MISC. BAIL APPLICATION No. - 21165 of 2024 Applicant :- Vidyadhar Yadav Opposite Party :- State of U.P. Counsel for Applicant :- Dev Raj Singh,Harish Kumar Shukla,Janardan Yadav,Neeja Srivastava,Vikrant Pandey Counsel for Opposite Party :- Chandra Bhan Yadav,G.A. Hon'ble Siddharth,J. Heard Ms. Neeja Srivastava, learned counsel for applicant; Raj Kumar Singh, Advocate, holding brief of Sri Chandra Bhan Yadav,
learned counsel for informant; learned AGA for State and perused the material on record. The instant bail application has been filed on behalf of the applicant, Vidyadhar Yadav, with a prayer to release him on bail in Case Crime No. 66 of 2024, under Section- 302, 201 of I.P.C., Police Station - Tehbarpur, District- Azamgarh. There are allegations in the F.I.R. that the marriage of the sister of the informant, namely, Vandana, took place in 2013 with co- accused, Kanhaiya Lal Yadav, and two children were born to the couple. His sister used to do the business of beauty parlour and a general merchant shop for earning livelihood. For purchasing land her husband and co-accused, Kanhaiya Lal Yadav, and other people were demanding money, but she expressed her apology. Thereafter, she was subjected to mental harassment and finally on 17.03.2024, the accused persons committed her murder and burnt her dead body in their house. Co-accused, Kanhaiya Lal Yadav, called the informant to his house and thereafter, disconnected the phone.
Learned counsel for the applicant has submitted that the applicant is aged about 60 years and has no concern with the aforesaid incident. The dispute may have taken place between the deceased and her husband, Kanhaiya Lal Yadav. He never demanded any money from the deceased nor he had any reason for the same. Learned AGA and learned counsel for informant have vehemently opposed the bail application and they have pointed out that the bail application of co-accused, Urmila Devi, has been rejected by a co-
ordinate Bench of this Court vide order dated 24.05.2024. They have pointed out that the dead body of the deceased was burnt inside the house wherein all the family members were present. They have clearly tried to make disappearance of the evidence of the crime. The applicant has rightly implicated in this case. He is father-in-law of the deceased and therefore, cannot be enlarged on bail. This Court after hearing the learned counsels for the parties does not finds any ground for enlarging the applicant on bail at this stage. The bail application is accordingly, rejected. The trial court is directed to conclude the trial against the applicant as expeditiously as possible, as per section 309 Cr.P.C. (new section 346 B.N.S.S.) Registrar(Compliance) is directed to communicate this order to the concerned court below within ten days.
