JUSTICE S SUNIL DUTT YADAV ORAL ORDER The present petition has been filed by the owners of land bearing Sy.Nos.18/6, 18/8 and 18/9 of Halasahalli Village seeking for issuance of order to restrain the respondent authority and its officials from carrying out demolition of the schedule properties. 2. It is the case of the petitioner that in the vicinity, there has been some encroachment of government land by certain other land owners. The neighbouring land owner who had suffered an order had filed W.P.No.28449/2025 which was allowed by setting aside the notice. Liberty was reserved to the respondent authorities to issue fresh notice and proceed further. 3. It is further submitted that after the survey, the Government authorities have identified certain portions of - 3 - HC-KAR NC: 2025:KHC:45515 WP No. 33770 of 2025 land for the purpose of demolition in Sy.Nos.18/1, 18/2, 18/7 and 18/10 for which demolition is imminent and slated for 11.11.2025. 4. However, it is submitted that insofar as petitioners' property in Sy.Nos.18/6, 18/8 and 18/9 at Halasahalli village, they have come to know that respondent authorities intend to demolish the Archway and compound walls, however they have not been issued any notice of survey identifying encroachment by the petitioners in the Government land abutting Sy.Nos.18/6, 18/8 and 18/9 at Halasahalli village. 5. Learned Additional Government Advocate upon instructions submits that they have information of encroachment. However, prior to taking any action, there would be survey in the presence of the petitioner and only thereafter, proceedings would initiated after issuing the notice. - 4 - HC-KAR NC: 2025:KHC:45515 WP No. 33770 of 2025 6. Taking note of such stand, the petition is disposed off. The respondent authorities not to take any steps including demolition as regards properties in Sy.Nos.18/6, 18/8 and 18/9 at Halasahalli village without following the procedure as indicated by the learned Additional Government Advocate noticed above. 7.
