The petitioner has been made accused in connection with Balumath P.S. Case No. 170 of 2023, Spl. POCSO Case No. 30 of 2024, for the offence registered under Sections 363, 365, 354, 376(3) of the Indian Penal Code and Sections 4, 8 & 18 of POCSO Act and thereafter, charge has been framed under Section 363 of the Indian Penal Code and Sections 6/18 of POCSO Act, pending in the court of learned Special Judge, POCSO, Latehar. On 27.11.2023, petitioner and co-accused persons kidnapped 14 years old girl and thereafter, petitioner is alleged to have raped her. Attention has been drawn towards the statement of the victim recorded during trial, in which, she has stated that she has not identified any of the accused persons and has been declared hostile. In view of the aforesaid fact, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned Special Judge, POCSO, Latehar, in connection with Balumath P.S. Case No. 170 of 2023, Spl. POCSO Case No. 30 of 2024. (Ambuj Nath, J.) BS/-
