Heard learned counsel for the parties and perused the record. 2. This writ petition has been filed seeking following relief :- "issue a order or direction to the Additional District Judge First Varanasi to decide the Civil Appeal No.04 of 2021 Santosh Kumar Gupta And Others Versus Anant Narayan Singh and Others (in Original Suit No.752 of 1994 Chatanki and Others Versus Vibhuti Narayan Singh) (being Annexure No.5 to this Petition). II. Issue a order or direction to the Respondent No.1 to 6, that they may not sale or raise any construction on old Plot No.2130/2 and new plot No.2388 Gaa having its Area 2 Acre 26 Decimal situated in Village and Post Pindra Pargana Kaulasal, Tehsil - Pindra District Varanasi, during pendency of Civil Appeal No.04 of 2021 Santosh Kumar Gupta And Others Versus Anant Narayan Singh and Others (in Original Suit No.752 of 1994 Chatanki and Others Versus Vibhuti Narayan Singh) Pending in the court of Additional District Judge First Varanasi, otherwise the petitioner and his family shall suffer grave irreparable loss and injury." 3. Learned counsel for the petitioner submitted that the above-mentioned appeal is pending consideration and the same has not been decided till date. Learned counsel prayed that the same may be decided, expeditiously. 4. Since the above-mentioned appeal is pending, no useful purpose would be served in keeping this petition pending. 5. In view of the above, this writ petition stands disposed of with a direction to Additional District Judge First Varanasi to decide the above-mentioned appeal, in accordance with law, expeditiously, preferably within six months from the date of production of a certified copy of this order, after ensuring service of notice upon all the respondents and providing opportunity of hearing to all the concerned parties provided there is no other legal impediment.
