1 THE HONOURABLE SRI JUSTICE K SREENIVASA REDDY CRIMINAL PETITION NO: 1370 OF 2025 ORDER: This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioners/A1 and A2, seeking regular bail, in Crime No.41 of 2024 of Munchingiput Police Station, Alluri Sitharama Raju district. 2. A case has been registered against the petitioners herein and others for the offences punishable under Sections 20(b)(ii)(C), 25 read with 8(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short ‘the NDPS Act’). 3. Case of the prosecution, in brief, is that, on 26.10.2024, at about 16.00 hours, on credible information about illegal transportation of Ganja, the Assistant Sub-Inspector of Police, Munchingiput Police Station, along with his staff and mediators, proceeded to Labburu village junction, Jolaput Panchayat and, while conducting vehicle checking, they found one person coming on a Pulsar Bike bearing registration No.OD 18 K 0139 and three persons in an Auto bearing registration No.OD 30 F 1039 from Barada village of Odissa. On seeing the police party, the driver of 2 the auto escaped from the spot. The police arrested remaining three persons and seized 100 Kgs of Ganja from their possession. The contraband along with vehicles and other material was seized under cover of a mediators report and a case has been registered against the accused. 4. Heard. Perused the record. 5. A perusal of the material on record goes to show that the contraband allegedly seized from the possession of the accused is 100 Kgs of Ganja, which is a commercial quantity. It is submitted by the learned Assistant Public Prosecutor that the investigation is not yet completed and other accused are to be apprehended. This is the second bail application and the earlier bail application filed by petitioner No.1 herein was dismissed by this Court on 30.01.2025. There are no changed circumstances since the dismissal of the previous bail application. In view of the aforesaid facts and circumstances of the case, this Court is not inclined to grant bail to the petitioners/A1 and A2 at this stage. 6.
