Respondent(s) For Applicant : Ms. Preeti Yadav, Advocate For Respondent(s) :
Hon’ble Shri Justice Arvind Kumar Verma, Judge Order on Board 03/02/2025
1. The present Criminal Revision is filed by the applicant under Section 19(4) of the Family Courts Act, 1984 against the order dated 27.04.2024 passed by the learned Additional Principal
2 Judge Family Court,Janjgir, District-Janjgir-Champa (C.G.) in Misc. Criminal Case No. 46/2023. 2. Brief facts of the case are that the applicant and respondent no. 1 got married on 12.05.2019 at Village Balod as per the rituals prevailing in their caste and respondent no. 2 a baby boy was born out of their wedlock on 19.09.2020. Since the marriage, the applicant and respondent no. 1 were residing together at the paternal home of the applicant, however on account of some family disputes between the parties, the family members of applicant started harassing the respondent no. 1. 3. Learned Counsel for the applicant contended that the applicant is not having enough source of income to pay Rs. 3000/- per month to the respondents and respondent no. 1 is having sufficient source to maintain herself. 4. I have heard learned counsel for the applicant and perused the record with utmost circumspection. 5. Perusal of record shows that the applicant and respondent no.
1. 6. The present Criminal Revision is being filed for setting-aside of the order awarding the amount of maintenance, i.e., Rs. 2000/- per month to respondent no. 1 (wife) and Rs. 1000/- to respondent no. 2 (minor son). 7. The cost of per litre milk ranges from Rs. 60/- to Rs. 70/- which costs to a total of Rs. 1860/- to Rs. 2170/-. Since respondent no. 2 is a minor son who is aged about 2 years, therefore, he needs extra care. 8. Since the respondent no. 1 is unable to maintain herself and her
3 minor son, therefore it is the responsibility of the applicant who is the husband of respondent no. 1 and father of respondent no. 2 to maintain his wife and child. 9. Thus, the amount of maintenance awarded by the Additional Principal Judge, Family Court, Janjgir, District- Janjgir-Champa (C.G.) is very meagre. Hence, the present Criminal Revision is hereby dismissed on merits. Sd/-
