1. Heard learned counsel for the appellants and learned Special P.P. for the State.
2. In view of the grounds taken in the limitation application, delay of 37 days in filing the appeal is condoned, as such, I.A. No.01/25 is allowed.

The learned counsel for the appellants that the offences for which the instant FIR was instituted carries punishment of seven years and less, but then the case was also instituted under the SC/ST (POA) Act, but then police has given notice under Section 35(3) of the B.N.S.S. to the appellants, hence for the present appellants do not apprehend arrest, thus
Patna High Court CR. APP (SJ) No.4248 of 2025(3) dt.01-07-2026 2/2 seeks permission to withdraw the appeal with liberty to file a fresh, if need arises.
4. Permission is accorded.
5. Accordingly, instant appeal is dismissed as withdrawn with the liberty aforesaid.
