(Presently Confined In Central Jail At Kota.) ----Petitioner Versus State Of Rajasthan, Through Public Prosecutor. ----Respondent For Petitioner(s) : Mr. Rajendra Singh Tanwar, Adv. For Respondent(s) : Mr. Sudesh Saini, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR
Order 27/03/2025
1. The instant bail application has been filed under Section 483 of B.N.S.S. on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No.153/2023, registered at Police Station Mandana, District Kota, for the offence(s) under Sections 8/15 of the N.D.P.S. Act.
2.
Learned counsel for the petitioner submits that the accused- petitioner has falsely been implicated for the offences under Sections 8/15 and 8/29 of the N.D.P.S. Act. It is contended that the accused-petitioner was arrested on 06.01.2024 and the accused-petitioner was not aware about the fact that the accused- petitioner has been declared absconded and charge-sheet has been produced against him under Section 299 of Cr.P.C. It is also contended that there is no conceivable evidence available on record against the accused-petitioner that the accused-petitioner
[2025:RJ-JP:14133] (2 of 3) [CRLMB-2114/2025] has supplied the contraband article to the main accused Mukesh. There is no connectivity between the present petitioner and the accused Mukesh, there are no criminal antecedents against the accused-petitioner and the trial of the case may take considerable time, therefore, the bail application of the accused-petitioner may be allowed. 3. Learned Public Prosecutor has vehemently opposed the grant of bail application. It is contended that the accused-petitioner remained absent from the investigation and warrant against him under Section 37 of the Police Act was obtained, thereafter, the accused-petitioner was chargesheeted under Section 299 of the Cr.P.C. The investigation would reveal that the accused-petitioner supplied the said contraband article to the main accused Mukesh, therefore, considering the conduct of the accused-petitioner and allegation levelled against him, the bail application of the accused- petitioner may be dismissed. 4. Heard and perused the material available on the record. 5. Apart from the disclosure statement of the other co-accused, there are no other substantive evidence available on record which shows that the accused-petitioner has supplied the contraband article to the main accused Mukesh. Though the accused- petitioner was declared absconded but considering the fact that the accused-petitioner is in custody since 06.01.2025 and trial of the case may take considerable time, therefore, without expressing anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioner on bail. 6.
Accordingly, the bail application under Section 483 of B.N.S.S. is allowed and it is ordered that the accused-petitioner-
