By way of the instant petition, the petitioner has prayed for the following reliefs:- 10.1 That, the Hon’ble Court may kindly be pleased to direct ASHUTOSH MISHRA Digitally signed by ASHUTOSH MISHRA Date: 2025.08.13 16:35:48 +0530 2 / 4 the respondent authorities to settle and pay the compensation in accordance with law as the land bearing khasra no. 333 area 0.240 Hectare (6 Decimale) situated at Village Sendari Tahsil & Distt Bilaspur (C.G.) was acquired for the purpose of construction of National High Way, in the year 2017 with short spun of time. 10.2 That, the Hon’ble Court may kindly be pleased to direct the respondents to decide the representation of the petitioner and further to award the just and fair compensation with interest in accordance with law. 10.3 Any other relief, which may be deemed fit and proper in the facts and circumstances of the case, may also be allowed. An affidavit is filed herewith. 2. The grievance of the petitioner is that though the respondent authorities have acquired the land of the petitioner in the year 2017 for the purpose of construction of road from Sakri to Korba but till date the compensation in lieu of acquisition of his land has not been paid to the petitioner. 3. Learned counsel for the petitioner contended that the respondent authorities have acquired the land of the petitioner bearing Khasra No.333, admeasuring 0.0240 Hectare (6 Decimals) situated at village Sendari, Tehsil & District Bilaspur, C.G. and the respondent authorities are giving assurance but nothing has been done despite the fact that in revenue records the name of the petitioner has been mentioned, therefore, there is no dispute with regard to title of the land. He would lastly contend that the petitioner has made a representation before the respondent authorities on 03/01/2023 3 / 4 which is still pending, therefore, the respondent authorities may be directed to decide the same or demarcate the land of the petitioner and decide the claim of the petitioner. 4. Learned counsel for the respondents submit that they are ready to demarcate the land of the petitioner. 5. I have heard learned counsel for the parties at length and perused the documents with utmost circumspection. 6. On perusal of the record I have found that the Competent Authority for Land Acquisition-cum-Sub Divisional Officer (Revenue), Bilaspur, C.G. has sent a memo to the Project Director, National Highways Authority of India, Bilaspur dated 26/03/2025, which reads as under:- कार्याालर्या सक्षम प्राधिकारी भू& अर्जन एवं अनुविवभागीर्या अधिकारी ¼ रा½ विलासपुर ¼N-x-½ ज्ञापन क्रमांक@211@अ-विव-अ-@भू&अर्जन@2025 विलासपुर विनांक 26-03-2025 प्रधि] परिरर्याोर्जना विनेशक] भा-रा-रा-प-का-ई- विलासपुर ¼N-x-½ विवषर्या%& पेण्ड्रीडीह& पथरापाली राष्ट्रीर्या रार्जमाग विनमाण में प्रभाविव ग्राम सेंरी स्थि/थ भूविम ख-नं-- 333 के अर्जन के संं में। संभ%& आपका पत्र क्र-10558 एवं हसीलार का पत्र क्र- 53 वि- 20-03-2025 &&&00&&& संर्भिभ विवषर्याांग के संं में लेख है विक पेण्ड्रीडीह- पथरापाली राष्ट्रीर्या 'रार्जमाग विनमाण में प्रभाविव ग्राम सेंरी स्थि/थ भूविम ख-नं- 333 रका 0-240 हे-@240 व-मी- माग विनमाण में प्रभाविव होने था भू& अर्जन से छु ट र्जाने पर हल्का पटवारी द्वारा द्वारा प्र/ु पत्रक 10 आपको पूव में भी भू& अर्जन अधिविनर्याम 1956 की ारा ३ए के ह् प्रकाशन की कार्यावाही विकए र्जाने हेु लेख विकर्याा गर्याा था। उक्त के संं में आपके द्वारा संर्भिभ पत्र के माध्र्याम से उक्त 4 / 4 भूविम ख-नं- 333 र्यावि प्रभाविव हो रहा है ो एलाईनमेंट नक्शा में टांकन कराे हुर्याे भारीर्या राष्ट्रीर्या रार्जमाग भू- अर्जन अधिविनर्याम 1956 के ह् कार्यावाही विकए र्जाने हेु लेख विकर्याा गर्याा था। उक्त के संं में ग्राम' सेंरी स्थि/थ भूविम ख-नं- 333 रका 240 व-मी- का हसीलार विलासपुर से /थल विनरीक्षण कराए र्जाने हेु पत्र लेख विकर्याा गर्याा। हसीलार विलासपुर द्वारा उक्त भूविम राष्ट्रीर्या रार्जमाग में प्रभाविव होना था प्र/ाविव एलाईमेंट में मूल नं- 333 र्भिश होना था उक्त ख-नं- नं- 333 रका 0-240 हे-@240 व-मी- टुकड़ों में विवभक्त नहीं होने था पूण रका माग विनमाण में प्रभाविव होने से टांकन की आवश्र्याका नहीं होने का प्रधिवेन प्र/ु विकर्याा गर्याा है। अः आप ग्राम सेंरी स्थि/थ भूविम ख-नं- 333 रका 240 व-मी- रार्जमाग अधिविनर्याम 1956 के विनर्यामानुसार कार्यावाही अविवलं अवग कराना सुविनधिF करें। सक्षम प्राधिकारी भू& अर्जन एवं अनुविवभागीर्या अधिकारी ¼ रा-½ विलासपुर ¼N-x-½ 7. Looking to the grievance raised by the petitioner, it is directed that the concerned Tehsildar under the supervision/guidance of Respondent No.4-Sub Divisional Officer ( R ), Bilaspur shall make a team and demarcate the land of the petitioner and thereafter Respondents No.2 & 3 shall proceed to decide the claim of the petitioner expeditiously as soon as possible, preferably within a period of 90 days from the date of receipt of copy of this order. 8. It is made clear that this Court has not made any observation with regard to the merits of the case and the respondent authorities shall be at liberty to proceed in accordance with law. 9.
