Order
[2025:RJ-JP:6490] (2 of 3) [CRLMB-2027/2025] 13/02/2025 These instant bail applications have been filed under Section 483 of BNSS on behalf of accused-petitioners. The petitioners have been arrested in connection with FIR No. 20/2025 registered at Police Station Malarna Doongar, District Sawaimadhopur for the offence under Sections 319(2), 318(4), 316(2), 336(3), 338, 340(2), 61(2)(a) of BNS and Section 66C and 66D of IT Act and Section 13 of RPGO.
Learned counsel for the petitioners submits that the accused petitioners have falsely been implicated in this case. Counsel further submits that offences alleged to have been committed by the petitioners are exclusively triable by Magistrate. The accused- petitioners are in custody since long and the trial of the case may take considerable time, therefore, the petitioners may be enlarged on bail. Per contra, learned Public Prosecutor opposes the grant of bail application. Considering the arguments advanced by the counsel for the parties and looking to the fact that the case of the petitioners is triable by Magistrate. The accused-petitioners are in custody since long and the trial of the case may take considerable time, without expressing anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioners on bail. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioners
1. Vijendra @ Golu S/o Rajesh, 2. Shashi Prakash S/o Harimohan,
3. Golu S/o Manoj, in connection with FIR No. 20/2025 registered at Police Station Malarna Doongar, District Sawaimadhopur shall be
[2025:RJ-JP:6490] (3 of 3) [CRLMB-2027/2025] enlarged on bail provided them furnish a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for their appearance before the court concerned on all the dates of hearing as and when called upon to do so.
