1. The present petition has been filed under Article 226/227 of the Constitution of India for quashing the impugned order dated 05.01.2011, Annexure P-1, passed by the Labour Court, whereby, the case of the petitioner has been rejected.

Learned counsel for the petitioner pleads no instructions, and submits that earlier the instant matter was adjourned sine die to await the award in the reference proceedings under Section 2-A read with Section 10(1)(c) of the Industrial Disputes Act, 1947, and he is not aware of the outcome of the award.
3. In view of the above, this Court is left with no other option, but to dismiss the petition for want of prosecution, however, liberty is reserved for the petitioner to get the same revived, in case, cause of action still survives.
