JUSTICE MOKSHA KHAJURIA KAZMI, JUDGE O R D E R 21.12.2024 Heard on CM No. 8005/2024 which is an application for restoration of contempt petition CCP (D) No. 10/2023 which was disposed of by this Court vide order dated 28th February 2024 as withdrawn on account of the respondents having stated before this Court that compliance is complete and that the appointment order on the post of Diabetic Educator has been issued. Pursuant to the said submissions being made before this Court, main contempt petition was disposed of as withdrawn. Today, the application CM No. 8005/2024 discloses that despite the passage of more than eight months and the applicant having joined the Institute on 9th March 2024 as so stated by the present Director of the SKIMS, Dr. Ashraf Ganai, who has also stated that the applicant is presently working in the Policy Section and is also eligible for salary. However, he has further stated that there are certain documents that are pending verification. This Court finds it very surprising that since the verification has to be done at the Institute itself, the administration of SKIMS has not been able to verify these documents even after the passage of eight months. This certainly puts a question-mark on the administrative prowess of the Director of SKIMS and others. The present Director, SKIMS and Mr. Firdous Ahmad Dar who is in the administration of SKIMS against whom personal allegations have been leveled by the applicant herein, shall also be included in this contempt petition as contemnor Nos. 3 and 4. Registry to update the cause title of the contempt petition. Both the contemnors shall file their personal affidavit and statement of facts as to what they have done to ensure that the applicant though appointed is allowed to work. CM No. 8005/2024 is allowed.
