1. The petitioner is before this Court seeking the following prayer: a. “Issue a writ in the nature of certiorari or any other
order or direction and quash the impugned orders bearing no. ¢.².R/ ¸À.² / C. D. £Ë/ ¥Àæ¸ÁÛªÀ£É 2023-2024 dated 23/11/2023 passed by the respondent no.5 vide Annexure-J and impugned order bearing no. ¹1. ¹.D : C D£ÉÃ: ¥Àæ.zÀ.¸À111: 2020-2021 1635 dated 25/09/2023 passed by the respondent no.6 vide Annexure-K and pass appropriate orders in the interest of justice and equity. b. Pass such other order(s) as this Hon’ble Court may deem fit to meet the ends of justice and equity.”
2. Heard Sri.Sharad M Patil, learned counsel for the petitioner and Smt.Girija S. Hiremath, learned HCGP for respondents. 3. The petitioner had earlier approached this Court with an identical prayer in W.P. No.105287/2023, which was disposed of on 30th August 2023, by the following order:
1. “The petitioner is before this Court seeking a direction by issuance of a writ in the nature of mandamus directing respondent Nos.1 to 6 to consider the representation dated 08.02.2023. - 4 -

2. Heard the learned counsel Sri. Sharad M. Patil appearing for the petitioner and the learned High Court Government Pleader appearing for the respondents. 3. The father of the petitioner, who is an Assistant Teacher in the Government High School, Kulahalli, Jamkhandi taluk, dies in harness on 20.04.2019 leaving behind two children, one of whom is the petitioner. The brother of the petitioner submits a representation to the respondent seeking appointment on compassionate grounds on the death of the sole bread winner of the family. The representation is submitted on
08.02.2023. Non-consideration of the representation is what drives the petitioner to this Court in the subject petition. 4. The learned AGA would submit that if reasonable time is granted, the representation of the petitioner would be considered on its merit and appropriate orders would be passed in accordance with law. 5. The submission is placed on record. 6. In the light of the said submission, I deem it appropriate to dispose of the petition with a direction to the respondents to consider the representation of the petitioner and pass appropriate orders in accordance with law within three months from the date of receipt of copy of this order. It is made clear that this Court has not pronounced on the merit of the claim of the petitioner. Ordered accordingly.”

Pursuant to the earlier direction to consider his representation, the impugned order has been passed. The impugned order rejects the petitioner’s claim on the ground that the application was not submitted within one year from the date of death of the employee. 5.
Learned counsel for the petitioner has now placed on record a representation submitted by the petitioner’s brother seeking compassionate appointment for the petitioner. The said communication has been received by the respondents and reads as follows:

6. The representation is dated 25.11.2019. The father of the petitioner had died on 20.04.2019. Therefore, the reason assigned in the impugned communication that no application was filed within one year from the date of death is, on the face of it, incorrect. Consequently, the petitioner is entitled to relief, and a direction is issued to the respondents to consider the petitioner’s case for compassionate appointment strictly in accordance with law, without rejecting it on frivolous grounds such as non- submission of the application within one year, particularly when the records indicate otherwise. 7.
Learned counsel for the petitioner further submits that the petitioner’s brother has also consented to the petitioner’s appointment, and an affidavit to that effect is placed on record.
8. In light of these circumstances, and despite the vehement opposition of the learned HCGP, who contends that the

grievance ought to be raised before the Karnataka Administrative Tribunal since the matter relates to compassionate appointment and this Court notes that the earlier petition on the same issue had been entertained. Therefore, I deem it appropriate to entertain the present petition as well, in order to issue necessary directions to consider the petitioner’s case, bearing in mind the observations made in the course of this order.
9. For the aforesaid reasons, the following order is passed:
ORDER i. The writ petition is allowed ii. The impugned order bearing No. ¢.².R/¸À.²/C.D.£Ë/¥Àæ¸ÁÛªÀ£É 2023-2024 dated 23.11.2023 passed by respondent No.5 vide Annexure-J, and the impugned order bearing No. ¹1.¹.D : C D£Éà : ¥Àæ.zÀ.¸À111 : 2020-2021 : 1635 dated 25.09.2023 passed by respondent No.6 vide Annexure-K, are hereby quashed. iii. The respondents shall now consider the petitioner’s case in accordance with law, bearing in mind the observations made in the course of this order, and shall pass appropriate orders within 12 weeks from
