(ORDER) 19.05.2025 1. Case taken out of turn at the request of Mr. Mir Manzoor Ahmad, learned counsel for the petitioner. 2. The learned counsel for the petitioner submits that the petitioner has already preferred representations before the District Magistrate, Srinagar, which have been placed on record as annexure-V to the writ petition, wherein a request has been made for protecting his property under Jammu and Kashmir Migrant Immovable Property (Preservation, Protection and Restraint on Distress Sales) Act, 1997, which till date have not accorded consideration. 2. After arguing for a while, the learned counsel for the petitioner submits that the petitioner would feel satisfied, if the present writ petition is disposed of at this stage by directing the District Magistrate, Srinagar to take a call on the representations which have been preferred by the petitioner and are pending adjudication before the District Magistrate, Srinagar (respondent No.3 herein) within some reasonable period, to which learned counsel appearing for the respondents has no serious objection, provided the same are to be accorded consideration, strictly under rules and as per law. 3. With the consent of the learned counsel appearing for the parties, the instant petition is taken up for disposal at the stage. Accordingly, the same is disposed of with a direction to the respondent No.3 (District Magistrate Srinagar) to accord due consideration to the representations alleged to have been filed by the petitioner and which have been placed on record as annexure-V, within a period of six weeks from the date a copy of this order along-with writ petition is made available to the District Magistrate Srinagar. 4. It is made clear that, while according consideration to the representations of the petitioner, the District Magistrate, Srinagar, shall afford an opportunity of being heard to the private respondents 5 and 6 as well as also other stake holders, if any, interested in the subject matter. 5.
