Side) ORDER The petitioner, who was arrested and remanded to judicial custody on 16.05.2025, for the offence punishable under Section 420 of I.P.C., 1860 in 1/4 https://www.mhc.tn.gov.in/judis Crl.O.P.No.17368 of 2025 connection with Crime No.204 of 2024, on the file of the respondent, seeks bail. 2.The case of the prosecution is that the petitioner and other accused gave false promise that the petitioner is working as an Area Manager in a bank and he would provide jewel loan for higher amount with subsidy and also give higher rate of interest for the deposit amount, thereby cheated the de-facto complainant and others by taking 217.5 sovereigns of gold jewels and cash of Rs.86,70,000/-. Hence the case. 3.The contention of the learned counsel for petitioner is that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. Except for the reason that petitioner is friend of A1, there is no other overt act against him. The petitioner has been in judicial custody from 16.05.2025. Side) appearing for the respondent police submitted that the petitioner along with A1, who is the Manager of a private bank, had convinced the innocent villagers stating that they would be granted loans. From the villagers they collected around 217.5 sovereigns of gold jewels and cash of Rs.86,70,000/- by projecting various schemes. The rustic villagers believed the petitioner and A1. The petitioner seen with A1 as shadow moving closely with A1 through and through. Hence, strongly opposed for granting bail to the petitioner. 5.Considering the submissions made on either side, it is seen that petitioner and A1 are friends.
