This is an application under Section 483 of the BNSS 2023, whereby the petitioner, Adnan Sahid Khan @ Adnan Shaid Khan has prayed for releasing Page No.# 2/2 him on bail after he was arrested in connection with Gorchuk Police Station Case No. 18/2025 under Section 140(3) of BNS, 2023 (GR No.355/2025). The informant has lodged an FIR with the allegation that the petitioner had kidnapped his 17 years old daughter. Case diary reveals that the parents of the girl were not maintaining cordial relationship and that is why she wanted to make complaint to her grandparents. For that matter, she forced the present petitioner to give her company so that she can go to the house of her grandparents. It may be mentioned herein that the victim girl was recovered on the same day of the occurrence. Apart from the aforesaid facts, there is no other incriminating material against the present petitioner. Therefore, the petitioner no longer deserves to be detained in custody. His bail prayer is allowed. It is directed that the petitioner, Adnan Sahid Khan @ Adnan Shaid Khan who was arrested in connection with Gorchuk Police Station Case No. 18/2025 shall be released on furnishing bail bond of Rs.25,000/- with a suitable surety of like amount to the satisfaction of the learned CJM, Kamrup (M), Guwhati.
