This is a petition for initiating contempt proceedings against the respondents for wilful disobedience and non-compliance of order dated 14th February 2024 passed in LPA No. 174/2023, whereby the Division Bench of this Court while dismissing the appeal had issued direction to the revenue authorities to demarcate the land of the petitioner within a period of four weeks and to find out as to whether any excess land belonging to the petitioner had been occupied by the respondent-Department. On being put on notice, respondents have filed their statement of facts and have placed on record a copy of communication dated 2nd January 2025 issued by Tehsildar D.H.Pora to the Assistant Commissioner, Revenue, Kulgam, a perusal whereof clearly indicates that on demarcation, they have not found Jal Shakti Department in possession of even an inch of land belonging to the petitioner. As a matter of fact, the total land mutated in favour of the Jal Shakti Department is 1 kanal and 15 marlas, whereas, on demarcation, the revenue agency has found the Department of Jal Shakti in possession of only 1 kanal and 11 marlas. Be that as it may, the facts remains that the judgment passed by this court stands complied with and therefore no cause survives to continue these proceedings. The proceedings in this case are, therefore, closed leaving it open to the petitioner to work out his remedy before the appropriate forum in case he is still aggrieved.
