Mr. S.C. Bhatt, Advocate for the petitioners. Mr. N.S. Pundir, D.A.G. for the State/respondent nos. 1, 3 and 4. Mr. Sanjay Bhatt, Advocate for the respondent nos. 2 and 5. By means of the instant petition, the petitioners seek directions that their names may be included in the Panchayat Electoral Roll, 2025, of Gram Panchayat- Karanpur, Tehsil Jaspur, District Udham Singh Nagar. The petitioners also claim other reliefs. Heard learned counsel for the parties and perused the record.
Learned counsel for the petitioners would submit that the petitioners have already made an application along with the necessary challan for enrolling their names in the voter list, but the respondents- authorities are not considering on it due to rejection of the earlier writ petition, being WPMS No.2888 of 2024, Abdul Karim and Others Vs. State of Uttarakhand and Others, which was decided by this Court on
24.10.2024.
Learned counsel for the respondent nos. 2 and 5 would submit that if the application of the petitioner is in order, along with all necessary challan, it shall be considered in accordance with law, and mere rejection of WPMS No.2888 of 2024, Abdul Karim and Others Vs. State of Uttarakhand and Others, shall have no
bearing on it. Having considered, this Court is of the view that there is no reason to keep this writ petition pending. It may be decided at this admission stage only. If the petitioners file necessary applications, as required under the rules, with all the necessary documents, the respondents-authorities shall consider it as per the existing Rules and Regulations. This Court makes it clear that rejection of WPMS No.2888 of 2024, Abdul Karim and Others Vs. State of Uttarakhand and Others, on 24.10.2024, shall have no impediment in deciding the application that may be filed by the petitioners.
