The petitioner had filed the petition challenging the inaction on the part of the municipal authorities in not taking action against the unauthorized constructions in the layout plans, which were stated to have been made without any permission from the concerned municipal authorities in an extent of Ac.0-25 cents in Sy.Nos.161/4A and 161/5A situate in Joharapuram Village, Kallur Mandal, Kurnool District. 2. / 2 / / 3. The writ petition was disposed of by the learned single Judge considering the statement and the stand of the private respondents herein that there was an inter se dispute pending before a civil Court in which order of status quo has since been passed. In that view of the matter, the learned single Judge observed that no further orders are necessary in the writ petition. 4. Learned counsel for the appellant would submit that the learned single Judge ought to have appreciated the crux of the controversy and notwithstanding the pendency of the dispute inter se between the appellant and the private respondents, no construction could be permitted on the land in question without the requisite permission from the Municipal Corporation. 5. We are in agreement with the stand of the appellant. Notwithstanding the pendency of the proceedings before the civil Court and in the absence of an order against the authority, the official respondents would be obliged by the statutes to ensure that no construction on the spot is permitted by any person without obtaining proper permission in that regard. Be that as it may, we dispose of this appeal with a direction to the Kurnool Municipal Corporation to verify as to whether there is any construction being raised by private respondent Nos.4 and 5 over the property falling in Sy.Nos.161/4A and 161/5A situate in Joharapuram Village, Kallur Mandal, Kurnool District. If at all there is any construction being so raised without 6. permission, then, appropriate action be taken in accordance with the relevant i 3 statutes after giving private respondent Nos.4 and 5 an opportunity of being heard.
