THE HONOURABLE SRI JUSTICE K SREENIVASA REDDY CRIMINAL PETITION NO: 1391 OF 2025 This Criminal PetI'tiOn, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A4, seeking bail, in Crime No.32/2023 of G.Madugula Police Station, AIluri Sitharamaraju District. 2. A case has been registered against the petitioner and others for the offences u/See.20(b)(ii)(C), 25 read with 8(c) of the Narcotic Drugs and Psychotropic substances Act. 3. Case of the prosecutl®on, in brief, is that, on 25.7.2023 at about 6.30 Pm, On receipt Of Credible informatI'On regarding illegal possession and transportation of ganja, the s.I of police, G.Madugula Poll'ce Stall-on, along with staff rushed to M.R.O.Office Junctl'on, G.Madugula and started vehicle checking. They noticed two persons coming in a car bearing no.MH 46 K 0079, and on seeing police, they tried to run away by stopping the car. Then police apprehended them. on enquiry, they disclosed their identity Particulars and police found 80 kgs of ganja in their possession in the car and they confessed that they purchased the same from the petitioner/A4. Basing on their confession, name of the petitioner was added in the F.I.R and police arrested the petitioner on o3.01.2025. 4. Heard. Perused the record. 5.
Learned Assistant Public Prosecutor submits that major part of the investigation is completed except fiII'ng Of Charge Sheet. He further submitted that he was informed that the father of the petitl-oner died on

A perusal of the material available on record goes to show that the pet'ltioner was arrested and remanded to judicial custody on 03.01.2025. |t police on credible information seized 80 kgs of ganja from other accused. pursuant to the confess'lonal statement of co-accused, nothing has been seized from the pet'[tioner to connect the petitioner w'[th the crime. Basing on the confessional statement of co-accused, the petitioner has been arrested and got remanded to judicial custody on 03.01.2025 and since then he has been in judicial remand. Learned counsel for the petitioner Submits that father of the petitioner died on 22.02.2025 and the petit-loner has tO perform the rituals. 7. In view of the aforesaid facts and Circumstances Of the Case, this court is inclined to grant bail to the petitioner/A4 herein, on the following conditions. (i) The petitioner/A4 here-ln shall be released On his executing a personal bond for Rs.10,000/-(Rupees ten thousand Only) With two sureties for a like sum each to the satisfaction of the learned Judicial First Class Magistrate, Paderu; (ii) on release, the petitioner shall appear before the Station House offilcer concerned once in a week i.e. on every sunday between 10.00 a.m. and o5.00 p.m., till filing of charge Sheet. 8.
