In compliance of the aforesaid order, a report has from the concerned jurisdictional Court that the compromise between the parties is genuine and arrived at without any pressure or coercion from anyone. 4. Learned State counsel, on instructions from ASI Charjeet Sharma, submits that Jaswind time of incident and he did not receive any injury. As such, he, at the most, can be made a prosecution witness and cannot be treated as victim. Further, the complainant has already appeared and gave his co FIR (supra) on the basis of compromise. 5. In view of the compromise and the ratio of law laid down by the Hon’ble Supreme Court in and another, (2014) 6 SCC 46 Kaushalya (Mrs.) and others (1980) 1 SCC 63 Kulwinder Singh Vs. State of Punjab 2007 (3) RCR (Crl.) 1052 is allowed and 341, 323, 506, 34, 379 and 59 of Arms Act at Police Station City Rampura, District Bathinda (Annexure P-2) quashed, qua the petitioner

A copy of this order be sent to learned trial Court/Illaqa Magistrate through fax for compliance. In compliance of the aforesaid order, a report has from the concerned jurisdictional Court that the compromise between the parties is genuine and arrived at without any pressure or coercion from Learned State counsel, on instructions from ASI Charjeet Sharma, submits that Jaswinder Singh was present with the complainant, at the time of incident and he did not receive any injury. As such, he, at the most, can be made a prosecution witness and cannot be treated as victim. Further, the complainant has already appeared and gave his co ) on the basis of compromise. In view of the compromise and the ratio of law laid down by the Hon’ble Supreme Court in Narinder Singh and others vs. State of Punjab and another, (2014) 6 SCC 46, and Shakuntala Kaushalya (Mrs.) and others (1980) 1 SCC 63 and Full Bench of this Court in Kulwinder Singh Vs. State of Punjab 2007 (3) RCR (Crl.) 1052 is allowed and FIR No.71 dated 25.06.2024 registered under Sections 342, , 34, 379-B of Indian Penal Code, 1860 and Section and 59 of Arms Act at Police Station City Rampura, District Bathinda and all consequential proceedings arising out of the same are quashed, qua the petitioners.
