In the instant contempt petition, the petitioner herein has complained non-compliance of order dated 18.04.2018 in terms whereof, while disposing of the writ petition of the petitioner being SWP No. 2616/2016, respondents came to be directed to accord consideration to the claim of the petitioner in accordance with rules provided the petitioner’s husband is similarly situated with the petitioner of SWP No. SWP 782/1998. 2. Statement of facts have been filed by the respondents accompanied with a consideration order bearing No. Est/NG/5091-98 dated 07.04.2023, wherein it has been stated that the claim of the petitioner’s husband was considered in tune with the order passed by this Court on 18.04.2018 and was found to be devoid of any merit being not similarly situated with the petitioner of SWP No. 782/1998. 3. Having regard to the aforesaid position obtaining in the matter, seemingly the respondents have complied with the order passed by this Court, requiring the recalling of contempt notice and closure of proceedings. 4. Order accordingly. 5. However, the petitioner shall be at liberty to work out a remedy against the consideration order dated 07.04.2023, if so advised.
