Neutral Citation No. - 2025:AHC:84675 Court No. - 85 Case :- CRIMINAL REVISION No. - 4089 of 2024 Revisionist :- Naushad Ahmad Opposite Party :- State Of U.P. And 2 Others Counsel for Revisionist :- Avanindra Kumar Mishra,Pravesh Kumar Tripathi Counsel for Opposite Party :- Chandra Bhushan Tiwari,G.A. Hon'ble Kshitij Shailendra,J.
1. Heard learned counsel for the parties and perused the record.
2. The instant revision has been filed challenging the order dated 11.01.2024, whereby the learned Additional Principal Judge, Family Court-1, Mau has disposed of proceedings under Section 125 Cr.P.C. covered by Case No. 997 of 2014 directing the applicant to pay a sum of Rs. 1,500/- per month to the wife w.e.f. 21.05.2007 and a sum of Rs. 500/- per month to the child of the parties from the said date until he attains majority. Further direction has been issued that from the date of order dated 11.01.2024, a sum of Rs. 3,000/- per month shall be paid to wife as maintenance and Rs. 1,000/- per month to the child until he attains majority.
3. Assailing the order impugned, learned counsel for the applicant submits that at the time of filing of the application in the year 2007, the son of the parties, namely Mohd.Ayyaz Ahmad, was minor, however, he has attained the age of majority and, therefore, the applicant is not liable to pay any amount to him.
4. Per contra, learned counsel for opposite party no. 2 raised various submissions on merits of the case and, as regards the status of the son, it is not disputed that he has attained the age of
majority.
5. In this background of facts, the submission advanced by the applicant's side, that despite the son having attained majority the applicant is being coerced to pay amount to him, does not have any substance inasmuch as the order impugned is quite clear and liability to pay amount of maintenance to the son is restricted up to the age of his attaining majority. No other point has been raised before this Court.
6. The revision has no merit and is dismissed.
7. Necessary consequences of the order impugned shall follow and the amount lying as arrears towards the applicant in terms of the
order shall be computed, in case the opposite party no. 2 proceeds for getting the order executed.
