Learned counsel for the petitioner submits that since the petitioner is only claiming Grade-III pay scale, which is infact in the nature of time bound pay scale, suffice it would be if a direction is given to respondent No.6- The District Superintendent of Education, Lohardaga to consider the claim of the petitioner and pass an appropriate order. 3. Considering his submission, since the petitioner is claiming Grade-III pay scale, I direct the respondent No.6 to pass an appropriate order on the representation of the petitioner. If it is necessary the matter be placed before the District Education Establishment Committee, who will take a decision and will pass a reasoned order as per law also taking into consideration whether any similarly situated person has been given the said benefit or not. 4. If it is found that the petitioner is entitled for the relief, consequential benefit should be granted to the petitioner. If the claim of the petitioner is rejected, the respondents are directed to hand over a copy of the said rejection order to the petitioner. 5. The entire process should be concluded within a period of twelve weeks from the date of receipt of a copy of this order along with a representation. 6. With the aforesaid observation, the instant writ petition stands disposed of. (ANANDA SEN, J.) R.S.
