BEFORE HONOURABLE MR. JUSTICE MANISH CHOUDHURY ORDER Date : 10.02.2025 Heard Mr. I. Hassan, learned counsel for the petitioners; Ms. P.R. Mahanta, learned Standing Counsel, Revenue Department for the respondent no. 1 and Mr. H. Sharma, learned Additional Senior Government Advocate, Assam for the respondent nos. 2 & 3. The petitioners have approached this Court alleging non-payment of compensation against acquired land. The petitioners have earlier approached this Court by way of a writ petition, W.P.[C.] no. 6546/2024 with the similar grievance and the said writ petition was allowed to be withdrawn when the learned counsel for the petitioners had submitted that the petitioners would withdraw the writ petition and would prefer a written representation before the official respondents. By the Order dated 09.12.2024, the writ petition, W.P.[C.] no. 6546/2024 was allowed to be withdrawn. By this writ petition, the petitioners have approached this Court again on the ground
Page No.# 3/3 that they have submitted a representation on 19.12.2024 before the respondent no. 3. On going through the contents of the writ petition, it appears that the writ petition is bereft of the material particulars. On the other hand, the petitioners have relied on a Notice dated 02.04.1992 issued to the grandfather of the petitioner no. 3 in L.A. Case no. 16/1991-92. Prima facie, the grievance of the petitioners appears to be stale. Be that as it may. Mr.
Hassan, learned counsel for the petitioners has submitted that the petitioners may be allowed to withdraw this writ petition with the liberty to approach again with better particulars on the matter of non-payment of compensation against the acquired land. In view of the above submissions made by Mr. Hassan, learned counsel for the petitioners, the writ petition stands dismissed on withdrawal with the liberty to approach again on the aspects indicated by Mr. Hassan.
